Nursing Home Hit With Wrongful Death Case

A lawsuit was filed Wednesday on behalf of the family of a Texas woman who was allegedly neglected during her stay at Kountze Nursing Center. The suit claims that Alice Wyatt met her demise as a direct result of the care given or lack thereof in her final days. The suit has been filed against not only the nursing home but also South East Texas Medical Associates, Memorial Herman Healthcare System and Dr. Mark Wilson.


The suit alleges that assessments made by her caregivers in her final days were less than adequate and directly lead to her death. Wyatt was admitted to the nursing home in mid-April of 2005 and ultimately passed away in November of the same year.

"She was not adequately assessed, the care plan did not properly account for her needs; she was not adequately nourished, was not adequately hydrated, not adequately repositioned, was not given the correct equipment, not adequately monitored and not adequately medicated," the suit said.

The suit goes on to say the defendants had cause to believe that Wyatt was being abused and neglected but failed to report the information to the Department of Human Resources or to a local or state law enforcement agency.

They attorneys representing the plaintiffs have insisted on a trial by jury.
