Bayer Faces New “Economic Injury” Lawsuit Over Trasylol

A new lawsuit has been filed against Bayer in response to the controversy currently surrounding Trasylol. This lawsuit however does not make a personal injury claim against the company, as many others do. The lawsuit filed last month is pursuing a claim of “economic injury.” The lawsuit claims that Bayer actively marketed Trasylol despite knowing that there were safer and cheaper alternatives. Trasylol can cost $1000 per injection, while alternatives can cost as little as $50.

 

The plaintiff, Jerry Saine, claims that he was caused “economic injury” after being treated with Trasylol during his 2006 heart surgery  "Had defendants honestly disclosed the true efficacy and dangers of Trasylol, physicians and patients would have used less expensive and safer alternatives," the suit reads. No specific dollar claim has been made at this point.
